- Primero. REVOCAR, por los motivos expresados, el fallo proferido por el Consejo de Estado, el día 30 de mayo de 1996 y, en su lugar, CONCEDER la tutela solicitada. En consecuencia, por constituir una vía de hecho, se revoca la sentencia del Consejo Superior de la Judicatura, del día 26 de octubre de 1995, dictada dentro del proceso disciplinario contra Francisco Javier Santamaría Hincapié.
- Segundo. Líbrense por Secretaría las comunicaciones a que se refiere el artículo 36 del Decreto 2591 de 1991.
