- Primero. REVOCAR la sentencia proferida por el Juzgado 55 Penal del Circuito de Santafe de Bogota el 13 de marzo de 1997 y, en su lugar, tutelar los derechos al debido proceso y a la defensa tecnica del actor Fernando Navas Talero.
- Segundo. ORDENAR a la Fiscalia General de la Nacion que en el plazo maximo de veinticuatro (24) horas contadas a partir de la notificacion de este fallo, proceda a asignarle la investigacion que alli se adelanta en contra del ciudadano German Nelson Osorio Sepulveda, radicada bajo el numero 29246, a un Fiscal Regional diferente al que hasta ahora viene a cargo de ese proceso.
- Tercero. ORDENAR que, por medio de la Secretaria General, se remita copia de esta providencia a la Procuraduria General de la Nacion para lo de su competencia.
- Cuarto. COMUNICAR esta sentencia al Juzgado 55 Penal del Circuito de Santafe de Bogota, para los fines contemplados en el articulo 36 del Decreto 2591 de 1991.
