- PRIMERO. REVOCAR los fallos proferidos en las dos instancias, por el Tribunal Contencioso Administrativo del Valle del Cauca el 2 de febrero de 1995 y por el Consejo de Estado, Sección 5ª, el 17 de marzo de 1995, por los motivos expuestos en la presente sentencia.
- SEGUNDO. CONCEDER, como mecanismo transitorio, la tutela en favor de LIBIA CUESTA, protegiéndosele su derecho fundamental al trabajo, y consecuencialmente se ORDENA: Que en el plazo máximo de un año, contado a partir de la presente fecha, se reincorpore a LIBIA CUESTA al puesto que tenía cuando se le decretó la pensión de invalidez, o sea: Supervisora Dependiente de la Secretaría de Servicios Administrativos o a otro de igual o semejante categoría, con el salario que hoy devengaría si hubiere continuado en sus labores y teniéndose en cuenta que se mantiene un grado de incapacidad valorado en un 20%, dándole la Gobernación del Valle del Cauca preferencia absoluta para su readmisión en la primera vacante que se produzca dentro de las condiciones de categoría y salario antes señalados.
- TERCERA: El Juzgador de primera instancia vigilará el cumplimiento de la presente sentencia.
- CUARTA: Líbrense por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
- QUINTO. Envíese copia de esta providencia al Defensor del Pueblo.
