- Primero. REVOCAR la decision de segunda instancia proferida por la Seccion Primera del Consejo de Estado en la tutela promovida por Hernando Torres Ortiz, en cuanto la declaro improcedente, y en su lugar CONCEDERLA por violacion al debido proceso y en consecuencia ORDENAR a la Sala Administrativa del Consejo Seccional de la Judicatura del Atlantico, que remita en el termino de diez (10) dias, al Consejo de Estado lo pertinente para que se resuelva la colision y una vez resuelta esta se profiera resolucion motivada por la entidad que el Consejo de Estado indicare.
- Segundo. Para los efectos del articulo 36 del decreto 2591 de 1991, el Tribunal de origen hara las notificaciones y tomara las medidas adecuadas.
