Primero. REVOCAR la decision proferida por la sala de Casacion Laboral de la Corte Suprema de Justicia del 4 de diciembre de 1997, y en su lugar CONFIRMAR la decision proferida en primera instancia por la Sala Laboral del Tribunal superior de Barranquilla del 6 de noviembre del mismo ano, pero con base en las consideraciones expuestas en la parte motiva de esta sentencia.
Segundo. La orden que se imparte en esta sentencia debera cenirse a los criterios senalados en el acapite identificado como "caso concreto", de la parte motiva de esta sentencia.
Tercero. COMPULSAR copias de todo lo actuado al Ministerio de Trabajo y Seguridad Social y a la Superintendencia de Sociedades, para lo de su competencia.
Cuarto. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
