- Primero. REVOCAR la sentencia proferida por el Juzgado
- Décimo. Penal Municipal de Barranquilla. En su lugar, TUTELAR el derecho a la seguridad social del señor Emiro Manuel Martínez Portillo.
- Segundo. ORDENAR a la Coordinadora del Grupo Nóminas de la Caja Nacional de Previsión Social, Cajanal, doctora Claudia María Jiménez Correa o a quien haga sus veces, para en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia, incluya en nómina al señor Emiro Manuel Martínez Portillo, sí aún no lo hubiere hecho.
- Tercero. ORDENAR que por Secretaria General de esta Corporación se compulsen copias de la presente decisión a la Procuraduría General de la Nación, para que en virtud de lo indicado en el artículo 19 del decreto 2591 de 1991, se investigue la posible responsabilidad de la Coordinadora del Grupo Nóminas de la Caja Nacional de Previsión Social, Cajanal, doctora Claudia María Jiménez Correa o de quien haga sus veces, ante la omisión de remitir las pruebas solicitadas por esta Corporación.
- Cuarto. Por Secretaria General, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
