Primero. REVOCAR la sentencia del Juzgado
Segundo. Penal del Circuito de Santa Marta, de fecha once (11) de noviembre de mil novecientos noventa y ocho (1998). En consecuencia, no se concede la acción de tutela pedida por Luis Alberto Santana Arias contra el Instituto de Seguros Sociales.
Segundo. Por la Secretaría de esta Corporación, COMPÚLSENSE copias del expediente y de esta sentencia a la Fiscalía General de Nación, a la Procuraduría General de la Nación y al Consejo Seccional de la Judicatura, Sala Jurisdiccional Disciplinaria, de Santa Marta, para los fines que consideren pertinentes.
Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
