- PRIMERO. REVOCAR la sentencia del 16 de enero de 2003, proferida por el Juzgado
- Tercero. Penal del Circuito de Santa Marta, y en su lugar, CONCEDER el amparo de los derechos invocados por la señora María del Rosario Navarro González, por las razones expuestas en esta providencia.
- SEGUNDO. ORDENAR al Gerente del Instituto de Seguros Sociales de Santa Marta, o a quien haga sus veces, que en el término de cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, proceda, si no lo hubiere hecho, a incluir en nómina a la señora María del Rosario Navarro González y consecuente con ello le pague la pensión de sustitución que le fue legalmente reconocida.
- TERCERO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
