- PRIMERO. Revocar la sentencia del 27 de enero de 1994 proferida por la H. Corte Suprema de Justicia-Sala de Casacion Laboral.
- SEGUNDO. Confirmar la sentencia del 14 de mayo de 1993, dictada por el Tribunal Superior del Distrito Judicial de Cucuta - Sala Laboral que concedio la tutela impetrada, como mecanismo transitorio, por violacion de los derechos al trabajo y de asociacion y libertad sindical, con la adicion de que la correspondiente accion contenciosa administrativa debio haberse instaurado dentro de los cuatro (4) meses contados a partir de la fecha en que se puso en conocimiento del peticionario la resolucion No. 0744 del 30 de marzo de 1993 y que la medida de tutela estara vigente mientras se falle el correspondiente proceso por la jurisdiccion de lo contencioso administrativo.
- TERCERO. Tutelar el derecho de peticion del actor; en tal virtud, el Servicio Nacional de Aprendizaje SENA dara respuesta a las peticiones de permiso elevadas por aquel dentro del termino de 48 horas.
- CUARTO. Ordenar que por Secretaria General se comunique esta providencia en la forma y para los efectos previstos en el art. 36 del decreto 2591.
