- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- REVOCAR la sentencia proferida por el Juzgado Regional de Bogotá el treinta (30) de diciembre de 1996, y en su lugar conceder la tutela de los derechos fundamentales del recluso Jimmy Lozano Rodríguez. En consecuencia se dispone:
- Primero. ORDENAR a la Pagaduría de la Cárcel Nacional Modelo de Bogotá cancelarle al recluso Jimmy Lozano Rodríguez lo adeudado en materia de sueldos o bonificaciones correspondientes a los meses de julio, agosto y septiembre de 1996, dentro del término de las cuarenta y ocho (48) horas siguientes, contadas a partir de la notificación de esta sentencia, siempre y cuando dichos valores no se hubieren cancelado con anterioridad a la notificación de la presente providencia.
- Segundo. PREVENIR a la Pagaduría de la Cárcel Nacional Modelo para que en lo sucesivo se abstenga de incurrir en las acciones y omisiones que dieron lugar a la formulación de la presente acción de tutela.
- Tercero. LÍBRENSE por Secretaría General las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
