- Primero. REVOCAR el fallo de 7 de diciembre de 1999, proferido por el Juzgado
- Segundo. Penal del Circuito de Santa Fe de Bogotá.
- Segundo. CONCEDER la tutela del derecho de petición, y ordenar al Fondo de Prestaciones Sociales del Magisterio de Santa Fe de Bogotá, que en el término de cuarenta y ocho (48) horas siguientes a la notificación de este fallo, responda de fondo la petición de la señora Ana Yolanda Tabares de Botello. Igualmente la Fiduciaria la Previsora deberá agilizar los trámites que sean de su competencia y que permitan al Fondo de Prestaciones del Magisterio, responder en debida forma la solicitud de la demandante.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
