en nombre del pueblo y por mandato de la Constitución,
R E S U E L V E:
Primero. REVOCAR la sentencia proferida por el Juzgado 45 Civil del Circuito, el 8 de abril de 1999 en el proceso de tutela de la referencia, y en su lugar RECHAZAR por improcedente la tutela interpuesta por la señora Rosa Helena Murillo Guevara.
Segundo. Hacer un llamado a prevención al Director del Fondo Nacional de Prestaciones Sociales del Magisterio para que dentro de los términos legales, proceda a resolver materialmente la solicitud formulada por la peticionaria, respecto al reconocimiento de su derecho a gozar de las cesantías parciales.
Tercero. Líbrense por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
