- Primero. REVOCAR la sentencia expedida por la Sala Penal del Tribunal Superior de Santafé de Bogotá D.C., el 14 de julio de 1998.
- Segundo. TUTELAR los derechos constitucionales fundamentales a la igualdad y al trabajo en condiciones dignas y justas de María Consuelo González Cuesta, específicamente en cuanto al principio "a trabajo igual, salario igual" y a la primacía de la realidad en materia laboral.
- Tercero. ORDENAR al Instituto de Seguros Sociales que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, nivele salarialmente a la peticionaria al cargo de Profesional Universitario Grado 30. De no ser suficiente la disponibilidad presupuestal para ello, el Instituto deberá agotar todas las gestiones necesarias para que la nivelación sea un hecho, a más tardar, en tres (3) meses contados a partir de la notificación de esta sentencia.
