Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior de Barranquilla. En su lugar, TUTELAR el derecho fundamental a la seguridad social del senor Manuel Francisco Altamiranda Rivera.
Segundo. ORDENAR al Fondo de Pensiones Territorial del Distrito de Barranquilla - Secretaria de Hacienda - Alcaldia Distrital de Barranquilla, como ultimo empleador del accionante, para que en el termino maximo de cuarenta y ocho (48) horas, contadas a partir de la notificacion de la presente sentencia, comience a prestar directamente, todos los servicios medico - asistenciales que requiera el actor, obligacion que debera cumplirse hasta tanto, la justicia ordinaria laboral resuelva acerca del reconocimiento o no de la pension reclamada.
La Sala advierte sin embargo, que el senor Altamiranda Rivera debera acudir ante la jurisdiccion ordinaria laboral, a efectos de poder reclamar su derecho a la pension.
Tercero. Por Secretaria General, librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
