Primero. REVOCAR el fallo de la Corte Suprema de Justicia, Sala de Casación Laboral, proferido el 24 de noviembre de 1999, al resolver sobre la acción de tutela incoada por ROSARIO HELENA BARRERA GONZALES contra el Departamento del Magdalena y el Fondo Territorial de Pensiones y Cesantías del Magdalena y en su lugar, CONCEDER la protección solicitada.
Segundo. ORDENAR al Gobernador del Departamento del Magdalena y a la Representante Legal del Fondo Territorial de Pensiones y Cesantías del Magdalena, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, proceda a la cancelación de la totalidad de las mesadas pensionales que se adeudan a Rosario Helena Barrera González, si existe partida presupuestal suficiente. En caso de no existir, pagarán en la medida en que la disponibilidad lo permita y adelantarán inmediatamente los trámites presupuestales necesarios para cumplir lo ordenado en esta providencia.
Tercero. El desacato a lo aquí dispuesto dará lugar a la aplicación de las sanciones previstas en el artículo 52 del Decreto 2591 de 1991.
Cuarto. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1.991.
