- Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Penal, el 20 de noviembre de 2001, dentro de la acción de tutela interpuesta por los ciudadanos José Ricardo Ochoa Durán, Jorge Eliécer Vargas Valenzuela y Luis Alfonso Robles, en cuanto dejó sin efecto la providencia proferida por el Tribunal Superior de Neiva, Sala Penal, en esta acción de tutela.
- Segundo. CONFIRMAR la sentencia dictada por el Tribunal Superior de Neiva, Sala Penal, pero por las razones expuestas en esta providencia.
