- Primero. REVOCAR la Sentencia del Juzgado
- Cuarto. Civil del Circuito de Valledupar de fecha 26 de mayo de 2000.
- Segundo. TUTELAR el derecho fundamental a la educación invocado por el actor Carlos Julio Ravelo Peralta. En consecuencia se ordenará que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia el ISS - Seccional Valledupar, restablezca el pago de la mesada pensional, incluyendo nuevamente en nómina al actor, de acuerdo con la ley y el contenido de la Resolución No. 005819 del 30 de octubre de 1995.
- Tercero. El Desacato a lo dispuesto en el presente fallo se sancionará en la forma prevista en los artículos 52 y 53 del Decreto 2591 de 1991.
- Cuarta. Por Secretaria general, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
