Primero. REVOCASE el fallo proferido por el Consejo de Estado en el asunto de la referencia, fechado el 3 de septiembre de 1998. En su lugar, SE CONFIRMA la sentencia de primera instancia, dictada por el Tribunal Administrativo del Quindío, el 13 de julio del mismo año, la cual deberá ser cumplida por el establecimiento educativo dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente Fallo.
Segundo. El desacato a lo aquí dispuesto será sancionado, en cabeza de la rectora del Colegio, de la manera como contempla el artículo 52 del Decreto 2591 de 1991.
Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1.991.
