- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Civil Municipal de Bello (Antioquia) y, en su lugar CONCEDER la tutela impetrada por la señora María Nubia Pérez de Hoyos en su calidad de agente oficiosa de su nieto Jaime Alexis Zapata Jaramillo.
- Segundo. ORDENAR a la EPS Comfenalco demandada en este proceso, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, si ya no lo hubiere hecho, disponga lo necesario para que se le practique al menor Jaime Alexis Zapata Jaramillo la intervención quirúrgica que requiere, y se le preste toda la atención médica necesaria para preservar su vida y su salud.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
