PRIMERO. REVOCAR en su totalidad la sentencia de la Sala de Familia del Tribunal Superior del Distrito Judicial de Villavicencio, de fecha veinte (20) de septiembre de mil novecientos noventa y cinco (1995), la cual confirmó la decisión del Juzgado Promiscuo de Familia de San José del Guaviare del 14 de julio de 1995, providencia esta que concedió la tutela deprecada.
SEGUNDO. DENEGAR la tutela solicitada por Alba Neisa Giraldo Castañeda, en nombre propio y en representación de sus hijos menores Diego Fernando y Karen Edith Gómez Giraldo, contra el Departamento del Guaviare a fin de que les fueran protegidos sus derechos fundamentales a la vida, a la salud, al trabajo, a la asistencia o seguridad social, a la subsistencia y a la integridad familiar.
TERCERO. DENEGAR la tutela oficiosa al derecho de petición de la parte actora.
CUARTO. COMUNICAR este fallo al Juzgado Promiscuo de Familia de San José del Guaviare, para los efectos previstos en el artículo 36 del decreto 2591 de 1991.
