- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. del Circuito de Santa Marta. En su lugar, TUTELAR el derecho fundamental de petición al señor Guillermo Miguel Escalante Ternera.
- Segundo. ORDENAR a la Empresa PALMACARIBE LTDA con sede en Santa Marta que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de la presente decisión, proceda, si aún no lo ha hecho, a dar respuesta a la petición del actor que dio origen a esta tutela.
- Tercero. Por Secretaria General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
