- Primero. REVOCAR las sentencias proferidas por los Juzgados
- Tercero. Civil Municipal y Treinta y Nueve Civil del Circuito, ambos de Bogota. En su lugar, CONCEDER la tutela por violacion de los derechos fundamentales a la salud y a la integridad personal en conexidad con la vida digna.
- Segundo. ORDENAR a la E.P.S. SANITAS que dentro del perentorio termino de cuarenta y ocho (48) horas a partir de la notificacion personal de esta sentencia, autorice y haga entrega del medicamento Pilocarpina (SALAGEN) a la senora MARIA JUDITH SANTAMARIA DE FORERO en la cantidad y por el tiempo que lo considere necesario su medico tratante.
- Tercero. SENALAR que la E.P.S. SANITAS, podra repetir contra el FOSYGA lo que desembolse en cumplimiento del presente fallo. El FOSYGA dispondra de maximo seis (6) meses para reconocer y pagar lo debido.
- Cuarto. El incumplimiento del presente fallo sera sancionado de conformidad con lo establecido por el articulo 52 del Decreto 2591 de 1991, relativo al desacato.
- Quinto. Por Secretaria, librese la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991.
