- Primero. REVOCAR la decisión proferida el 18 de julio de 2003, por el Juzgado
- Sexto. Civil del Circuito de Ibagué y, en consecuencia, CONCEDER la tutela de los derechos a la salud y la seguridad social en conexidad con la vida del señor Martín Emilio Salazar Giraldo.
- Segundo. ORDENAR a la Secretaría de Salud de Tolima que, en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia, adelante las gestiones de coordinación con el Hospital Federico Lleras de Ibagué y con las instituciones prestadoras de salud adscritas o con las que tenga contrato, en caso de considerarse necesario, se le practiquen al señor Martín Emilio Salazar Giraldo los exámenes Rayos X de Tórax, Serología para Hepatitis C, Antígeno de Superficie para Hepatitis B, Toxoplasma IgG, Citomegalovirus, Cuadro Hemático, Serología, Transaminasas (SGOT - SGPT), Fosfatasa Alcalina, Creatitina, Colesterol, Triglicéridos, Glicemia, Parcial de Orina, Carga Viral, Recuento CD4, Relación CD4/CD8, y se le suministren los siguientes medicamentos: Fluconazol, Trimetropin y Loperadina, cuyas órdenes reposan en el expediente. Lo anterior, sin perjuicio del derecho que le asiste para repetir contra el Fondo de Solidaridad y Garantía, Fosyga.
- Tercero. Por Secretaría General de esta Corporación, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
