- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- Primero. REVOCAR el fallo de tutela proferido por la Sala de Decision Penal del Tribunal Superior de Ibague, el 7 de octubre de 1999, y CONFIRMAR la sentencia de tutela dictada por el Juzgado
- Segundo. Penal del Circuito del Espinal, el 30 de agosto de ese mismo ano, en cuanto confirio el amparo solicitado por el municipio accionante, pero por lo derechos fundamentales y las razones expuestas en esta sentencia.
- Segundo. ORDENAR a la Caja Cooperativa de Ahorro y Credito Social -COOPERAMOS, sucursal Espinal, abstenerse, en adelante, de debitar o retener los dineros del municipio del Espinal provenientes de transferencias de la Nacion
- Tercero. Del cumplimiento de esa sentencia sera responsable el representante legal de la Caja Cooperativa de Ahorro y Credito Social - COOPERAMOS, sucursal Espinal, a quien se le advierte que el desacato sera sancionado en la forma prevista por el articulo 52 del Decreto 2591 de 1991.
- Cuarto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1.991.
