- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Trece Penal Municipal de Bogotá el 5 de septiembre de 2003, y en su lugar CONCEDER la tutela del derecho a la salud en conexidad con la vida del señor NELSON RAMIRO CULTID REVELO.
- SEGUNDO. INAPLICAR, con base en el artículo 4 de la Constitución Política, y para el caso concreto que fue objeto de examen por parte de esta Sala, el artículo 12 de la Resolución 5261 de 1994 del Ministerio de Salud, por la cual se establece el Manual de Intervenciones y Procedimientos del Plan Obligatorio de Salud.
- TERCERO. ORDENAR a la E.P.S. de SALUDCOOP de Bogotá que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación de esta Sentencia le suministre la malla 10x10 para la intervención quirúrgica de hernia inguinal recomendada por el médico tratante al señor NELSON RAMIRO CULTID REVELO.
- CUARTO. La E.P.S. de SALUDCOOP de Bogotá podrá repetir los gastos en que incurra en cumplimiento de este fallo, contra el Fondo de Solidaridad y Garantía.
- QUINTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
