Primero. REVOCAR la sentencia proferida por el Juzgado Treinta y Tres Penal Municipal de Cali, el veintinueve (29) de diciembre de mil novecientos noventa y ocho (1998) dentro de la acción de tutela de la referencia.
Segundo. CONCEDER la tutela impetrada. En consecuencia, se ordena al Rector de la Universidad del Valle que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, proceda a tomar las medidas necesarias para reanudar el pago de la mesada pensional del señor Salomón Alegría. En cuanto a los mesadas pensionales ya causadas y no pagadas, el demandante podrá acudir ante la jurisdicción ordinaria para exigir su pago.
Tercero. El Rector de la Universidad del Valle responderá personalmente por el cumplimiento exacto y oportuno de éste fallo, bajo el apremio de las sanciones previstas por el artículo 52 del decreto 2591 de 1991.|
Cuarto. LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
