- Primero. REVOCAR la sentencia proferida el 20 de noviembre de 1998 por el Tribunal Superior de Cundinamarca en el proceso de tutela de la referencia y, en su lugar, CONCEDERA la tutela frente la Universidad del Valle, según las consideraciones consignadas en la parte motiva de esta providencia.
- Segundo. ORDENAR al señor Rector de la Universidad del Valle que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia, proceda a reanudar el pago de la mesada pensional del señor Javier Gutiérrez.
- Tercero. La Universidad del Valle responderá por el cumplimiento exacto y oportuno de éste fallo, bajo el apremio de las sanciones previstas por el artículo 52 del decreto 2591 de 1991.
- Cuarto. LÍBRENSE las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
