Primero. REVOCAR el fallo proferido por el Juzgado Promiscuo Municipal de Istima (Chocó) el cinco (5) de abril de 2001, al resolver sobre la acción de tutela incoada por Jorge Isaac Gutiérrez contra la Alcaldía Municipal de Istmina, y, en su lugar, proteger el derecho a la salud en conexión con la vida digna del peticionario.
Segundo. ORDENAR al Alcalde Municipal de Istmina, que dentro de los cinco (5) días siguientes a la notificación del presente fallo, proceda a realizar las gestiones necesarias y asumir los costos, tendientes a asegurar que el actor sea valorado por un médico especialista en ortopedia, y como consecuencia de esa valoración, realizar el tratamiento y/o cirugía prescrita para la recuperación de su salud, si a esto hubiere lugar.
Tercero. Por Secretaría LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
