- Primero. Revocar la sentencia proferida por el Juzgado
- Segundo. Civil Municipal de Magangué en el trámite de tutela adelantado por Álvaro Suárez Prasca contra el municipio de Magangué, por la presunta vulneración de sus derechos a la igualdad, al acceso a la administración de justicia y a la seguridad jurídica; y en su lugar denegar el amparo solicitado.
- Segundo. Ordenar al municipio de Magangué que si no ha realizado el pago de las acreencias adeudadas al señor Álvaro Suárez Prasca, se abstenga de hacerlo y en su lugar, lo someta en cuanto a su oportunidad y efectividad al acuerdo de reestructuración respectivo.
- Tercero. Prevenir al Juzgado
- Segundo. Civil Municipal de Magangué, para que en lo sucesivo se abstenga de ordenar el pago de sumas de dinero en virtud del trámite de tutela, sin que se reúnan los requisitos excepcionales para su procedencia.
- Cuarto. Por secretaría general librar las comunicaciones de que trata el Decreto 2591 de 1991.
