- Primero. Revocar la sentencia proferida por la Seccion Primera del Tribunal Administrativo de Cundinamarca el dia nueve (9) de marzo de dos mil (2000), por medio de la cual se denego la tutela impetrada por Santiago Pernia Domico y otros, obrando individualmente y en representacion de las comunidades indigenas Embera-Katio del Alto Sinu.
- Segundo. Tutelar los derechos al debido proceso, a la igualdad, al acceso a la administracion de justicia, a la participacion y a la supervivencia fisica y cultural de los peticionarios.
- Tercero. En consecuencia, ordenar al Tribunal Superior del Distrito Judicial de Monteria, juez de primera instancia en este proceso, que de cumplimiento a lo dispuesto en el numeral
- tercero. de la parte resolutiva de la sentencia T-652 de 1998, en el sentido de dar tramite al incidente de regulacion de perjuicios promovido por los peticionarios.
- Cuarto. Por Secretaria librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991, para los efectos alli contemplados.
