- Primero. REVOCAR la sentencia proferida el 21 de Julio de 2003 por el Juzgado 22 Penal del Circuito de Medellín, dentro de la acción de tutela instaurada por Luz Osmany Torres Puerta contra Coomeva E.P.S. En su lugar, CONCEDER el amparo solicitado.
- Segundo. ORDENAR a la E.P.S. Coomeva que dentro de las cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia realice a la señora Luz Osmany Torres Puerta las pruebas diagnósticas solicitadas, en la forma prescrita por el médico tratante.
- Tercero. Señalar que a la E.P.S. COOMEVA le asiste el derecho de reclamar al FOSYGA los gastos asumidos en la realización de las pruebas prescritas.
- Cuarto. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
