- PRIMERO. REVOCASE el fallo de fecha 8 de febrero de 2006, proferido por el Juzgado 27 Penal Municipal de Bogota con funcion de Control de Garantias, que nego la tutela instaurada por Saul Aroca Varon, contra la EPS Sanitas S.A. En su lugar, CONCEDASE la accion de tutela, en los terminos expresados en la parte motiva de esta providencia.
- SEGUNDO. ORDENESE a la EPS Sanitas S.A. suministrar integralmente y durante el periodo necesario los tratamientos y medicamentos que le prescribio y prescriba el medico tratante adscrito a esa entidad, al senor Saul Aroca Varon, en especial y por ahora el medicamento denominado ENSURE 1000 mg, lo cual hara en el plazo maximo de las 48 horas siguientes a la notificacion de este fallo.
- TERCERO. Para obtener el reintegro de los valores que no este obligada legalmente a asumir, la EPS demandada podra repetir con cargo al Fondo de Solidaridad y Garantia (FOSYGA).
- CUARTO. LIBRENSE por secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
