- R E S U E L V E
- PRIMERO. REVOCAR la sentencia de tutela proferida por el Juzgado 24 Civil del Circuito de Santa Fe de Bogota de 2 de octubre de 1995. En su lugar, CONCEDER a Deyanhira Pintos Gomez la tutela de los derechos fundamentales a la identidad y a la propia imagen, de conformidad con los articulos 14 y 16 de la C.P. En consecuencia ORDENAR a LA CORPORACION SOCIAL PARA LAS COMUNICACIONES - CENPRO T.V.- cesar toda transmision, exposicion, reproduccion, publicacion, emision y divulgacion publica de las imagenes del parto de DEYANHIRA PINTOS GOMEZ.
- SEGUNDO. ORDENAR a la Comision Nacional de Television que con base en sus facultades legales prevenga y sancione, si encuentra merito para hacerlo, la transmision y reproduccion de las imagenes del parto de DEYANHIRA PINTOS GOMEZ en la Television Nacional y en sus distintos espacios.
- TERCERO. LIBRESE comunicacion al Juzgado 24 Civil del Circuito de Santa Fe de Bogota, con miras a que se surta la notificacion de esta providencia, segun lo establecido en el articulo 36 del Decreto 2591 de 1991.
