- Primero. REVOCAR la sentencia del veintiocho (28) de agosto de mil novecientos noventa y seis (1996), proferida por el Tribunal Superior de Armenia, Sala de Decisión Penal. En consecuencia, negar la tutela solicitada por el señor Luis Mora Martínez.
- Segundo. El Juzgado
- Segundo. Penal del Circuito de Calarcá, Quindío, deberá adoptar las medidas conducentes para el cumplimiento de la sentencia proferida por él el 2 de julio de 1996, en la que condenó al señor Luis Mora Martínez a cumplir 20 meses de prisión.
- Tercero. COMUNICAR esta decisión al Tribunal Superior de Armenia, Sala de Decisión Penal, para que sean notificadas las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
- Cuarto. Con el fin de proteger la identidad de la menor víctima del delito, se debe suprimir su nombre al hacerse pública esta sentencia.
