- PRIMERO. MODIFICAR la sentencia de mayo 19 de 1993, proferida por el Juzgado
- Quinto. Penal Municipal de Cali, en el sentido de CONDICIONAR el otorgamiento de la tutela solicitada por la peticionaria en favor de sus hijos por nacer a que, en el término de diez (10) días contados a partir de la notificación de la presente providencia, LEONARDO FABIO MERCHAN DIAZ reconozca su paternidad sobre los hijos gemelos de la señora BIRTHE VALENCIA RODRIGUEZ, de conformidad con lo expuesto en el numeral 8º de los fundamentos jurídicos. Expresamente se advierte que el reconocimiento deberá hacerse personalmente por MERCHAN DIAZ ante el Juez
- Quinto. Municipal de Cali. En lo demás se CONFIRMA.
- SEGUNDO. LIBRESE comunicación al mencionado Juzgado, con miras a que se surta la notificación de esta providencia, según lo establecido en el artículo 36 del Decreto 2591 de 1991.
