Primero. En cuanto al cargo general formulado por el demandante declarar EXEQUIBLES los arts. 1 a 40, con excepcion de los incisos 2deg y 3deg del art. 36 de la Ley 35 de 1993, en relacion con los cuales se rechazo la demanda por existir cosa juzgada segun sentencias C-252/94 y 597/95.
Segundo. Declarase INHIBIDA para fallar en relacion con el art. 2 de la ley 35 de 1993.
Tercero. ESTESE A LO RESUELTO en la sentencia C-496/98, en relacion con los arts. 10 y 11, inciso 2deg de la ley 35 de 1993.
Cuarto. Declarar EXEQUIBLE la referencia al articulo 3o. de la ley 35 de 1993, e INEXEQUIBLES las referencias a los articulos 5o., 6o. y 7o. de la misma ley.
Quinto. Declarar EXEQUIBLES los arts. 34 y 35, inciso 1deg, de la ley 35 de 1993.
Sexto. Declarar EXEQUIBLE el inciso 1deg del articulo 37 de la a ley 35 de 1993, en las condiciones determinadas en esta sentencia relativas al alcance del termino "funciones", e INEXEQUIBLE el inciso 2deg del mismo articulo.
