- Primero. Decláranse INEXEQUIBLES las expresiones "para la viuda si contrae nuevas nupcias y", pertenecientes al parágrafo del artículo 6 del Decreto 1305 de 1975.
- Segundo. Las viudas que con posterioridad al siete de julio de 1991 hubieren contraído nupcias y, por este motivo, perdido el derecho a la pensión a la que se refiere la norma, podrán, como consecuencia de este fallo, con miras al restablecimiento de sus derechos constitucionales, reclamar de las autoridades competentes las mesadas que se causen a partir de la notificación de esta Sentencia.
