- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E
- PRIMERO. Declarar inexequibles las expresiones "o cuando la viuda contraiga nuevas nupcias o haga vida marital" del articulo 2 de la Ley 33 de 1973; "o cuando contraiga nuevas nupcias o haga vida marital" del articulo 2 de la Ley 12 de 1975; y "por pasar a nuevas nupcias o por iniciar nueva vida marital" del articulo 2 de la Ley 126 de 1985.
- SEGUNDO. Las viudas que con posterioridad al siete de julio de 1991 hubieren contraido nupcias o hecho vida marital y, por este motivo, perdido el derecho a la que en la actualidad se denomina pension de sobrevivientes, podran, como consecuencia de este fallo y a fin de que se vean restablecidos sus derechos constitucionales conculcados, reclamar de las autoridades competentes las mesadas que se causen a partir de la notificacion de esta sentencia.
