Este derecho lo pierde el cónyuge sobreviviente cuando por su culpa no viviere unido al otro en el momento de su fallecimiento, o cuando contraiga nuevas nupcias o haga vida marital, y los hijos por llegar a la mayoría de edad o cesar la incapacidad.
