- Primero. Declarar INEXEQUIBLES, por las razones señaladas en esta sentencia, los artículos 85 y 107 de la Ley 136 de 1994, así como los artículos 51 y 52 de la Ley 241 de 1995.
- Segundo. Declarar EXEQUIBLE el artículo 280 de la Ley 4 de 1913, en el entendido de que es una regla general para los casos de períodos institucionales, pero que no se aplica a aquellos casos en que la Constitución establece un período individual para el respectivo servidor público.
- Tercero. Esta sentencia producirá efectos a partir del día siguiente de su notificación, conforme a lo señalado en el fundamento jurídico 25 de la parte motiva.
