- Primero. REVOCAR el fallo de 30 de mayo de 2003 proferido por el Juzgado
- Séptimo. Civil del Circuito de Barranquilla que negó la protección del derecho invocado. En su lugar TUTELAR el derecho de petición del señor Julio César Ortega Ariza.
- Segundo. ORDENAR al Seguro Social Seccional Atlántico que, si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia proceda a pronunciarse de fondo sobre el objeto de la petición elevada por el accionante.
- Tercero. REMITIR copia del presente fallo y del expediente a la Procuraduría General de la Nación, para que adelante la investigación disciplinaria a que haya lugar.
- Cuarto. PREVENIR al Seguro Social Seccional Atlántico para que en el futuro se abstenga de incurrir en esta clase de actuaciones que vulneran los derechos fundamentales de sus afiliados.
- Quinto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
