- PRIMERO. REVOCAR la sentencia proferida el 20 de marzo de 2002 por el Juzgado
- Cuarto. Penal Municipal de Barranquilla, y en su lugar denegar el amparo de los derechos invocados por CONSTRUCCIONES E INVERSIONES ZABARAIN DE LA ESPRIELLA LIMITADA -CIZALLA, con las consecuencias señaladas en la parte motiva de la presente sentencia.
- SEGUNDO. Dejar sin efectos el Convenio de Pago suscrito el 5 de septiembre de 2002 entre el alcalde de Barranquilla y el representante legal de la sociedad comercial Construcciones e Inversiones Zabaraín de la Espriella LTDA.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
