- Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Cúcuta en la tutela instaurada por ELVA MARINA SANTANDER MORALES. En su lugar, CONCEDER el amparo solicitado en los términos expresados en la parte motiva de esta providencia.
- Segundo. En consecuencia, ORDENAR a la Gobernación de Norte de Santander- Oficina de Escalafón- que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, resuelva de fondo la solicitud presentada por la demandante desde el 26 de marzo de 2002.
- Tercero. Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
