- Primero. REVOCAR el fallo proferido por la Sala Penal del Tribunal Superior de Bogotá, de febrero veintitrés (23) de dos mil (2000) que negó la tutela solicitada por Luz Dary García Rodríguez.
- Segundo. CONCEDER a la demandante Luz Dary García Rodríguez como mecanismo transitorio para evitar un perjuicio irremediable, la tutela de sus derechos fundamentales a la igualdad, a la especial protección constitucional a la maternidad y al mínimo vital. En tal virtud, ORDENASE al demandado Hernán Alfonso Rodríguez Blanco, identificado con Cédula de Ciudadanía No. 7.217.180 de Duitama (Boyacá), que dentro del término de cuarenta y ocho (48) horas contado a partir de la notificación de esta sentencia, pague a la demandante la indemnización correspondiente a sesenta (60) días de salario, más los salarios correspondientes a doce (12) semanas de descanso remunerado.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
