La menor demandante interpuso la acción de tutela en contra del INPEC, con el fin de que se le amparen sus derechos fundamentales y se le de respuesta a la solicitud que elevó, para que a su progenitora, quien paga una pena privativa de la libertad de más de catorce años, se le conceda el traslado del Centro Penitenciario ERON del municipio de Jamundí (Valle) a la cárcel El Buen Pastor de Bogotá, ciudad en la que ella reside actualmente.

En sede de revisión el instituto demandado allegó la constancia mediante la cual ordenó el traslado pretendido y en tal sentido, la Sala declara la CARENCIA ACTUAL DE OBJETO POR HECHO SUPERADO.
