- PRIMERO. REVOCAR la Sentencia de 2 de marzo de 2004, proferida por el Juzgado
- Séptimo. Penal Municipal de Barranquilla, en el caso del señor Jair Vargas Álvarez. En su lugar CONCEDER la tutela al señor Jair Vargas Álvarez en relación con el derecho al mínimo vital.
- SEGUNDO. ORDENAR a la Personería Distrital de Barranquilla que dentro de las cuarenta y ocho horas (48) horas siguientes a la notificación de esta decisión, si aún no lo a hecho, realice el pago de los salarios correspondientes a los meses de noviembre y diciembre de 2003 y enero y febrero de 2004. En caso que la Alcaldía de Barranquilla no hubiere realizado las transferencia correspondientes a los meses antes mencionados a la Personería Distrital de Barranquilla disponer que las realice en el término de diez (10) días a partir de la solicitud de la Personería al respecto.
- TERCERO. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
