Primero. REVOCAR el fallo proferido el 10 de julio de 2000, por el Juzgado
Sexto. Penal Municipal de Barranquilla. En su lugar, TUTELAR los derechos a la seguridad social, al trabajo y a la protección del mínimo vital del señor Oswaldo Alfonso Rodríguez Alvarez
Segundo. ORDENAR al señor Alcalde Distrital de Barranquilla, que dentro del término de cuarenta y ocho (48) horas siguientes a la notificación de ésta providencia, transfiera a la Personería Distrital, las partidas presupuestales necesarias para cubrir el pago de los salarios debidos y los aportes por concepto de salud. En caso de que no exista la respectiva partida, deberá realizar las operaciones presupuestales para garantizar dicha transferencia de recursos, en un término que no exceda de tres (3) meses.
Tercero. El desacato a lo ordenado en esta providencia, se sancionará de conformidad con lo señalado en el artículo 52 del decreto 2591 de 1991.
Cuarto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
