- Primero. REVOCAR la sentencia proferida el 17 de febrero de 2004 por el Juzgado
- Octavo. Penal del Circuito de Barranquilla, Atlántico, dentro de la acción de tutela promovida por Roque de Alba de la Hoz contra la Subdirección de Prestaciones Económicas de la Caja Nacional de Previsión Social "Cajanal".
- Segundo. DECLARAR la carencia actual de objeto, por existir un hecho superado.
- Tercero. ORDENAR a la Secretaría General de la Corte que expida y envíe copia de este fallo a la Procuraduría General de la Nación con el fin de que investigue la posible comisión de infracción disciplinaria por parte de servidores de la Caja Nacional de Previsión Social "Cajanal".
- Cuarto. Por Secretaría General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
