Primero. Revocar el fallo proferido por el Juzgado 26 Civil Municipal de Bogotá en el proceso de la referencia, y en su lugar tutela los derechos a la vida y a la salud de Francisco Javier Giraldo Plata.
Segundo. Ordenar a Colpatria Salud EPS que en el término de cuarenta y ocho (48) horas, contados a partir de la notificación de esta sentencia, se tomen las medidas necesarias, si no se ha hecho aún, para autorizar a Francisco Javier Giraldo Plata el injerto de goretex. La entidad podrá cobrar al Estado, a través del Fosyga, todos los gastos en los que incurra y que legalmente no le corresponda asumir. El término para el pago no podrá exceder de seis (6) meses una vez presentada la solicitud.
Tercero. Por Secretaría, librar la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
Cuarto. Para garantizar la efectividad de la acción de tutela, el Juzgado 26 Civil Municipal de Bogotá notificará esta sentencia en el término de cinco días, contados a partir del momento en que se haya recibido la comunicación a la que se hace referencia en el numeral anterior.
