- Primero. Revocar la Sentencia proferida el treinta y uno de mayo de 2004 por el Juzgado Diecinueve Civil Municipal de Bogota.
- Segundo. En su lugar, TUTELAR el derecho a la salud del senor Alvaro Casas, ordenando a la E.P.S. FAMISANAR que, si aun no lo ha hecho, en el termino de las cuarenta y ocho horas siguientes a la notificacion de la presente providencia reanude la atencion medica que requiere el demandante, y a la mayor brevedad posible autorice que se lleve a cabo el procedimiento quirurgico denominado "prostatectomia transuretral" necesario para el tratamiento de la hiperplasia de la prostata que padece, atendiendolo hasta la culminacion del periodo post operatorio y cubriendo totalmente los costos correspondientes.
